According to the Unfair Claims Settlement Practices Act (RIGL §27-9.1-4) there are rules insurance companies must follow as it relates to your right to obtain a rental vehicle when you are in accident.
Type of Vehicle You May Rent:
If you are a claimant, using another party’s insurance company, you are entitled to a rental vehicle comparable to the vehicle damaged in the accident. Comparable does not mean the same. If you have an SUV, you are entitled to an SUV rental; if you have a mid-sized vehicle, you are entitled to a mid-sized rental.
If you are an insured, your rental vehicle type is determined by the amount of your policy limit. For example, if you have purchased $40/ day policy, you are entitled to a vehicle in that category.
Length of Rental
As a claimant, you are entitled to a rental for the time it takes to repair your vehicle. However, an insurance company is not required to pay for delays caused by the vehicle owner or the repair facility.
As an insured, your rental time is limited to a maximum of thirty (30) days.
Additional Insurance
If you maintain an insurance policy in accordance with Rhode Island Law, you are not required to purchase additional insurance from a rental company. Do not cancel your insurance or remove your vehicle from your insurance policy while it is being repaired.
